Terms of Service

These Terms govern your access to and use of SeamlessPatternMaker.com (the "Service"). By using the Service, you agree to these Terms.
1) Who we are
The Service is provided by Artwand, Inc ("we," "us," "our").

2) Accounts and access
Sign-in is available via Google using Firebase Auth.
You are responsible for maintaining control of your account and keeping your sign-in secure.
We may suspend or terminate accounts for suspected abuse, fraud, or violation of these Terms.
3) Purchases, pricing, and taxes
The Service offers one-time purchases for features such as high-resolution downloads.
Payments are processed by Stripe. By purchasing, you authorize us (and Stripe) to charge your payment method for the displayed price plus any applicable taxes.
Prices may change prospectively at any time.
4) No refunds
All purchases are final and non-refundable.
If you are in a jurisdiction with statutory withdrawal rights for digital content, you request immediate access to the purchased content and acknowledge that your withdrawal/right-to-cancel (if any) is lost once delivery begins. This clause does not limit any non-waivable rights required by law.
5) Delivery
After successful payment, eligible features (e.g., 4K downloads) are unlocked immediately. If a delay occurs due to technical issues, we will make reasonable efforts to restore access.
6) License to generated patterns
Your license:
For each pattern you generate, we grant you a worldwide, non-exclusive, perpetual, royalty-free license to use, reproduce, display, and create derivative works from that pattern for commercial and personal projects, without attribution.
Restrictions:
You may not claim that we or others grant you exclusivity to any pattern or underlying style. You may not use the Service or outputs to build a competing pattern-generation service or dataset without our written permission.
Third-party rights:
You are responsible for ensuring your prompts and uses do not infringe third-party rights. We do not guarantee that all uses of outputs will be free from claims in every context.
7) Your content and acceptable use
Your content:
You retain rights to prompts, titles, and other content you submit. You grant us a license to process and store that content to operate and improve core features of the Service.
Prohibited content/uses:
No illegal, infringing, hateful, or harmful content; no attempts to reverse engineer, scrape, or bypass limits; no automated or bulk generation that degrades service stability.
8) Intellectual property
We (and our licensors) own all rights in the Service, including the site, brand, and UI. Except for the license in Section 6, no rights are transferred to you.
9) Availability and changes
The Service may change, suspend, or discontinue features at any time. We aim to avoid breaking changes but may need to update or remove features for performance, security, or legal reasons.
10) Disclaimers
The Service and outputs are provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement. Generated content may contain artifacts or inaccuracies.
11) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid for the purchase giving rise to the claim (if any) in the 12 months before the event.
12) Indemnity
You agree to indemnify and hold harmless Artwand, Inc from claims arising from your use of the Service or outputs, your content, or your breach of these Terms.
13) Termination
You may stop using the Service at any time. We may suspend or terminate access for violations or risk to the Service. Sections that by nature should survive (e.g., 4–12) will survive termination.
14) Governing law and disputes
These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-laws rules.
The state or federal courts located in Delaware, USA have exclusive jurisdiction, except where local law provides otherwise.
15) Changes to these Terms
We may update these Terms. Material changes will be effective on posting an updated "Effective date" at the top of the page. Your continued use after changes means you accept the updated Terms.
